Terms of Service

1. Acceptance

These Terms apply to InkArtists, operated by Dodo Media B.V. (KVK 72282983). By using InkArtists, you agree to these Terms. If you do not agree, do not use the platform.

2. Accounts

You are responsible for maintaining your account and ensuring information you provide is accurate. You must be at least 18 years old to use the platform.

3. Our role and the artist-client contract

InkArtists is a technology platform that helps clients discover independent tattoo artists and arrange bookings. Each artist is an independent service provider and, not InkArtists, supplies the tattoo service. When a client requests or accepts a booking, the tattoo-service agreement is made directly between that client and the artist identified on the booking. InkArtists acts as a disclosed facilitator of that agreement and does not sell, provide, or guarantee tattoo services.

4. Artist responsibilities

The artist is responsible for setting the tattoo price and deposit, deciding whether to accept a booking, delivering the tattoo service, complying with all laws and professional requirements, maintaining required licences and insurance, and handling service-related questions, cancellations, refunds, complaints, health and safety matters, and taxes connected with the tattoo service. InkArtists may provide support tools and help parties communicate, but does not control the artist’s professional work or become responsible for it.

5. Deposits, platform fees, and tax

Where payment is available, InkArtists may collect the artist’s booking deposit as the artist’s disclosed payment-collection agent and account for that deposit separately from InkArtists revenue. The deposit amount shown at checkout is payable to the artist and is intended to be remitted to that artist under the applicable booking and payout rules.

InkArtists may charge the client a separate booking or platform fee for use of the platform’s booking and payment-facilitation services. Any tax that applies to the InkArtists fee is shown separately before payment. The checkout total consists of the artist deposit, the InkArtists fee, and any applicable tax. Payment processors or crypto providers handle payment processing; InkArtists may absorb their processing costs as part of its fee.

The payment confirmation identifies the artist deposit and InkArtists fee separately. The artist remains responsible for taxes, invoices, and other obligations arising from the tattoo service, unless mandatory law states otherwise.

6. Cancellations, refunds, and disputes

The artist’s stated cancellation and deposit policy applies to the artist deposit, subject to mandatory consumer law. The artist decides service-related refunds and is responsible for refunding deposits where required by that policy or law. InkArtists may assist with payment administration, but a payment dispute, chargeback, or request for a refund does not by itself determine whether the artist must refund the deposit.

InkArtists fees and applicable tax are refundable only where required by law or where InkArtists confirms otherwise. We may delay payout, place funds on hold, or reverse a payout where reasonably necessary to address a payment dispute, fraud concern, refund, chargeback, or legal obligation.

7. Payment providers and payouts

Payment processing and artist payouts may be provided by third parties, including card-payment, payment-account, and crypto-payment providers. Their terms may apply in addition to these Terms. Artists must provide accurate payout and verification information. InkArtists may suspend payment collection or payout features where a provider, law, risk review, or compliance requirement requires it.

8. Content and portfolios

Artists retain ownership of their work. By posting content, you grant InkArtists a license to display it on the platform for promotion and discovery.

9. Prohibited use

• Using the platform for unlawful activity.
• Misrepresenting identity or work.
• Attempting to access or disrupt the platform or its users.

10. Termination

We may suspend or terminate accounts that violate these Terms or harm the community.

11. Disclaimer of warranties

The platform is provided \"as is\" without warranties of any kind. We do not guarantee uninterrupted service or specific outcomes from bookings.

12. Limitation of liability

To the maximum extent permitted by law, InkArtists is not liable for indirect or consequential damages. Our total liability is limited to the amount paid to us in the 12 months before the claim.

13. Governing law

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent courts in the Netherlands.
